Your Obligations as a Player

You may play games on our site solely for your own personal, recreational purposes. We ('we' or 'the company' or 'SkillGames' means GGweasle Limited, a company incorporated in Malta; and 'our' should be construed accordingly) may from time to time host "Professional Tournaments" in which players may participate on a professional basis.

By participating in games on our site you agree to abide by these Terms and Conditions, which are a contract between you and GGweasle Limited. The company reserves the right to change these Terms and Conditions at any time.

You must be 18 years of age or older to play any games on our site for money or other prizes of real monetary value. No player under the age of 18 will be able to recover wins or deposits.

You may not participate in our site in any way that violates any law, rule or regulation that applies to you or to us. Our site is not intended to be available to places or for purposes in which its use is illegal or otherwise prohibited.

The computer software that we make available to you is owned by us and protected by copyright laws. You may only use the software for your own personal, recreational uses in accordance with all rules, terms and conditions we have established and in accordance with all other applicable laws, rules and regulations.

Games played on our site should be played in the same manner as games played in any other setting. This means that players should be courteous to each other and avoid rude or obscene comments.

Each player at a table should be playing solely for him or herself and may not communicate information about his or her cards or betting strategy to other players either before or during a hand. As described elsewhere in our Terms and Conditions, we will nullify the results of any game in which the winner was determined to have had such assistance or cooperation from another player and will return to the losing players in that game, out of the winner's account, the amounts bet by the losing players.

While playing games on our site, you may not run programs on your computer (or computers or other devices linked to your computer) that analyze or direct the play of the game by accessing the information from our site. The company may monitor play to detect such unfair use of non-human computational or analytical devices. This monitoring may include collecting data about your playing and betting patterns and determining the programs running on your computer or computers or other devices linked to your computer. As described elsewhere in our Terms and Conditions, we will nullify the results of any game in which the winner was determined to have used such machine assistance and will return to the losing players in that game, out of the winner's account, the amounts bet by the losing players.

You agree to hold the company, its employees, officers, directors, licensees, licensors, Poker, and contractors harmless and further agree to fully indemnify them from any and all costs, expenses, liabilities and damages whatsoever that may arise as a result of your entry onto our site, any misinformation that you provide to us, any action that you take in violation of any of the rules, terms or conditions of our site, participation in any games or other activities on or made available to you through our site, the use of our software, or receiving cash, bonus playing points, prizes or awards from us or our sponsors.

By opening, maintaining and using an account, you represent and warrant and that you are not: a resident of any jurisdiction which does not allow the games or services provided by us to be offered or used; acting on behalf of another party; depositing monies originating from criminal and/or other illegal activities; depositing monies through a credit card which you are not authorized to use; conducting criminal activities involving, directly or indirectly, any Gamesgrid Account.

Basic Rules for Games

All games will be played in accordance with the specific Rules for Games that are set out on our website, as we may revise those rules from time to time. Although we believe the Rules for Games follow generally accepted rules for the games played on our site, there may be some differences between the Rules for Games and the rules with which you are familiar. In the case of any conflicts in rules, the Rules for Games will apply.

We may terminate any hand being played in any game, or stop offering any game, including during any tournament, if we determine that it is necessary to do so to comply with any of the rules, terms and conditions of our site, to comply with any law, rule, regulation or order applicable to us, to our site or to any player on our site, in response to technical difficulty that prevents the hand from concluding successfully, or to prevent fraud or abuse. If we terminate any hand at any time prior to its conclusion all bets made during that hand will be nullified and returned to the person who made them. No person will be entitled to any "winnings" or other benefits from a hand cancelled prior to its conclusion regardless of the probability (or certainty) that the person would have won the hand. We reserve the right to issue refunds as the sole resolution in the case of any failed tournament.

Security Measures and Information Gathering and Sharing

We are committed to providing a high level of security to our players. To do so, we need the cooperation of all players to allow us to conduct security evaluations on an ongoing basis. By signing up on or otherwise participating in the games on our site or opening an account with us, you authorize us to, at any time and from time to time, confirm your identity and take steps to validate the financial transactions you are performing on the site. To help these security checks, you agree to provide us with identification or other information or documents as we request.

Our site sometimes allows players from other sites to play at our tables or allows our players to play on tables at other sites. To do so, we have to share player data and other information with other sites and companies. By participating in our site, you acknowledge that this information sharing occurs and agree to it.

About Your Cash Account

You must have good funds available in a valid player account prior to playing any Real Money Games. Please note that regardless of the length of time an account is open, or the size of the account, no individual account will be entitled to obtain any interest. We will be the owner of any interest or other income generated by banking arrangements that we enter into for holding or transacting in funds.

You are responsible for maintaining the confidentiality of all of your account information, such as passwords, credit card numbers, associated contact addresses.

You can deposit funds into your player account by the methods that are specified in our cashier. We may change these methods at any time. We will not impose transaction fees that are paid to us (other than to reimburse us for payments we must make to third persons) for depositing funds into accounts. If you use a method that imposes a fee or other surcharge, you will be responsible for paying that fee or surcharge and the amount of funds deposited into your player account will be reduced by the amount of fee or surcharge if you do not otherwise make arrangements to pay it.

You may request to cash out and withdraw any or all of the balance in your player cash account at any time, subject to a minimum time period since your deposit, which varies by deposit method and exists to prevent fraud. There is no requirement to play any games or otherwise to have bought anything on our site to make a request and have your money returned.

Payment of funds cashed out may be made by check, wire, credit card and/or any other manner which the company selects in its sole discretion. Payments will be made as promptly as reasonably possible, but all payments are subject to any audit or review reasonably necessary to assure the validity of the account and the requested withdrawal. We may request documents to verify identity and/or authorization to use a specific credit card and/or other facts provided by the Account Holder, before accepting any particular deposits and/or withdrawals which may cause slight delays in the deposit or withdrawal.

We will impose and notify you of minimum and maximum transaction limits and possibly betting limits that apply to your player account. Different factors go into our setting these limits and they will change from time to time at our discretion. For example, we may establish and from time to time revise your limits depending upon the method and frequency of your depositing funds into accounts, the length of time you have had an account with us and your history of playing games on our site.

We are not responsible for any rules or restrictions imposed by or actions taken by credit card processors or payment solutions providers, including any delays by any of them in depositing funds or distributing funds or any decision by any of them not to deposit or to distribute funds from or to any person.

We may be required to file government reports of deposits into or withdrawals from accounts, and to withhold amounts due as taxes on winnings. By making a deposit, participating in games on our site, or requesting a withdrawal you consent to our filing such reports and making such government-required withholding. In addition, we will comply with all notices or orders that are served upon us with respect to claims against amounts held in your player cash account. In the event that there is a dispute over the entitlement to a withdrawal from an account, we reserve the right to transfer, or request that our financial services provider, deliver the funds to the appropriate court or governmental entity to hold the funds until resolution of the dispute. By making a deposit into a player account, you agree that we will not be responsible for any loss that occurs if we make or request such a transfer.

All of our accounts will be maintained in United States Dollars. If you wish to make deposits or have funds paid in a different currency, you will be responsible for all costs associated with the exchange of currencies. These exchanges will be handled by our banking Poker, but the fees, rates and other costs are set independently of us and we will not have any responsibility to you for them. All calculations and settlement of all matters involving exchange rates are done in accordance with financial institutions selected by us at currently applicable exchange rates. We do not warrant that these are the best available exchange rates at any time. Slight differences may occur between agreed amounts and recorded amounts due to variances between exchange rates among different institutions.

We will keep "play money" funds, playing credits, bonus and similar real money and non-money amounts separate from the real money funds kept in your player cash account. These non-cash amounts have no monetary value. They cannot be transferred into player money accounts, credited against costs (other than playing credits being credited against table fees) or otherwise withdrawn or exchanged from or within a player's money account.

If you request a transfer from your account to another player's account, every such transfer will be subject to our control and we reserve the right to refuse any such transfer.

The company from time to time will use different financial institutions and payment processing providers to facilitate deposits into, maintaining, transferring and making withdrawals from player cash accounts. By requesting to set up a player cash account, you consent to us using these institutions and providers, and you agree that instructions and information that you give to us may be shared with and given to the providers. This consent shall be in effect as long as you maintain an account with us, regardless of the cash balance of the account. Since each of the institutions and providers has its own terms and conditions of use, you agree that those terms and conditions of use will also govern your creation of, deposits into, maintenance of and withdrawals from your player cash account.

If you do not log into your player cash account at least once every 365 days, we can cancel your account. We will attempt to return to you any funds in the account, less any reasonable costs that we incur in locating you if you are not at the address you last provided for the account. If within 30 months from the time your account became dormant, we cannot locate you to return the funds to you, we will turn the funds over to the applicable governmental authority for appropriate disposition. In the latter case, you will not be able to make a claim against us.

We reserve the right in our sole discretion, at all times, to:

  • Decline to open an account and/or to close an existing account, without any explanation whatsoever;
  • Decline to accept deposits without any explanation whatsoever;
  • Request documents to verify identity, authorization to use a specific credit card and/or other facts provided by the Account Holder, before expediting deposits and/or withdrawals;
  • Transfer and/or license, without prior notice, the rights and the liabilities regarding an Account Holder to any other legal entity, in any country, ultimately managed and controlled by GGweasle or its successor, subject to GGweasle guaranteeing the liabilities being honored.
  • Hold and manage funds belonging to Account Holders in accordance with generally accepted guidelines for cash management regarding such funds; this may include a Financial Institution and/or a Payment Provider being entrusted to hold funds in the name of and/or for the benefit of Account Holders;
  • Forfeit and/or confiscate funds available on an Account and/or refuse to honor a claim, in the event that, directly or indirectly, these Terms and Conditions or the Rules of the Games have been violated and/or other unauthorized activities have occurred in connection with playing a game or the operation of a Account.

Penalties for Violations

If you violate any rules for play or otherwise violate our Terms and Conditions, we reserve the right to close your account, ban you from play on our site, and nullify the results of any game in which we determine that you won as a result, directly or indirectly of such a violation, and return to the losing players in that game, out of your account, the amounts bet by the losing players.

The following actions or violations will also lead to termination of your account and banning you from our site:

  • Maintaining an account in a false name or using other false identification or information in connection with obtaining or maintaining an account (this will include opening more than one account through an alias, variation on your name or otherwise);
  • You are found to have cheated in any way in any game;
  • Participating in the site in a manner that violates any applicable law;
  • Wrongly disputing or "charging back" purchases, deposits or other payments made to your account;
  • Refusing to comply with company requests for information or other assistance to confirm that your playing or the play of other players conforms to the rules and requirement of the site; or
  • Your disclosing or otherwise sharing account information that compromises the security of your account.
Please note that this is only a partial list. We hope that we never have to enforce our rules in this draconian manner, but reserve the right to do so to protect all of our players. We also reserve the right, in circumstances in which we find a violation was inadvertent or excusable, to allow a player to continue to participate in games on our site.

YOU ACKNOWLEDGE AND ACCEPT THAT THE COMPANY SHALL BE THE FINAL DECISION MAKER OF WHETHER YOU HAVE VIOLATED THE COMPANY'S RULES, TERMS OR CONDITIONS IN A MANNER THAT RESULTS IN YOUR SUSPENSION OR PERMANENT BARRING FROM PARTICIPATION IN OUR SITE.

Confidentiality and Privacy

The Company will protect your personal information and respect your privacy in accordance with best business practices. By disclosing your personal information to Company, you consent to the collection, storage, transfer and processing of your personal information to complete player account (cash and non-cash) related activities. You also consent to the our collecting, retaining and analyzing this information for our own administrative and operating purposes. We also will collect information from or about you through systems, including the use of cookies, and may inform you of changes, new services and promotions we think that you may find interesting. By participating in our site, you agree that we have the right to access and disclose your information as necessary to properly operate our systems, protect our company and other players on our site, and to comply with any regulatory or governmental requests, including disclosure or reporting of information related to any suspicious transaction under any law relating to money laundering. Because of the complex and constantly changing nature of our technology and business, we cannot guarantee error-free performance regarding the privacy of your personally identifiable information and you agree that we will not be liable for any incidental, consequential or punitive damages that arise from or relate to the use or release of that information.

NO WARRANTIES AND LIMITED LIABILITY

YOUR ACCESS TO GAMESGRID.COM AND PARTICIPATION IN THE GAMES ON THIS SITE IS AT YOUR SOLE OPTION, DISCRETION AND RISK. THE COMPANY SHALL NOT BE LIABLE FOR COMPUTER MALFUNCTIONS NOR ATTEMPTS OR FAILURES OF ATTEMPTS BY YOU TO PARTICIPATE IN GAMES HOSTED ON THE SITE. THE GAMES AND ANY SOFTWARE PROVIDED TO YOU ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY'S MAXIMUM LIABILITY TO YOU OR ANY THIRD PARTY ARISING OUT YOUR USE OF GAMESGRID.COM, ANY SOFTWARE PROVIDED BY THE COMPANY OR ANY GAMES OR HOSTED ON THE SITE, OR ANY OTHER ACTIVITY UNDERTAKEN IN CONNECTION WITH OR ARISING OUT OF THE ACTIVITIES OF GAMESGRID.COM, IT LICENSORS, LICENSEES, CONTRACTORS, AGENTS OR Poker, WHETHER FOR BREACH OF CONTRACT OR IN TORT, WILL BE LIMITED TO TWO TIMES THE AMOUNT, IF ANY, YOU PAID TO GAMESGRID.COM TO ACCESS ITS WEBSITE (REGARDLESS OF THE AMOUNTS THAT YOU MAY HAVE SPENT, LOST OR INCURRED ARISING FROM CONNECTING TO OR PLAYING ACTIVITIES UNDERTAKEN ON THE SITE). THE COMPANY WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH OR ARISING OUT OF YOUR USE OF GAMESGRID.COM, ANY SOFTWARE PROVIDED BY THE COMPANY OR ANY GAMES OR HOSTED ON THE SITE, OR ANY OTHER ACTIVITY UNDERTAKEN IN CONNECTION WITH OR ARISING OUT OF THE ACTIVITIES OF GAMESGRID.COM, IT LICENSORS, LICENSEES, CONTRACTORS, AGENTS OR Poker, HOWEVER THE LIABILITIES, LOSSES, OR DAMAGES ARISE, WHETHER FOR BREACH OF CONTRACT OR IN TORT, EVEN IF THE COMPANY RECEIVED PRIOR NOTICE OF THE POSSIBILITY OF SUCH DAMAGE, LOSS OR LIABILITY. IN NO EVENT, SHALL THE COMPANY BE LIABLE FOR ANY DAMAGE TO YOUR COMPUTER HARDWARE, SOFTWARE OR DATA.

Time for Claims

Any claim regarding a transaction in conjunction with an Account shall be made in writing to GGweasle within forty five (45) days after the transaction, payment and/or settlement took place, or should have taken place; any claim attempted to be made after that period shall be void and of no force or effect.

Applicable Law, Dispute Resolution and Regulatory Oversight

GGweasle Limited is a limited company incorporated in Malta and subject to Maltese law. The company's registered office is located at 66, Old Bakery Street, Valletta VLT 09, Malta. The company is fully licensed by the Malta Lotteries and Gaming Authority under the Malta Remote Gaming Regulations 2004. The law of Malta is the governing law regulating this contract between you and GGweasle Limited and any dispute between you and the company.

Miscellaneous

All GamesGrid rules, terms and conditions have been prepared and are published in English. Translations into other languages are made as a service and are made in good faith. However, in the event of ambiguity between the English version and a translation, the English version has priority over any translations.

We advise that all account holders familiarize themselves with the laws and regulations of the jurisdiction in which they are resident or from which they are participating to determine the laws and regulations that apply to them, including tax, gaming and wagering laws. GGweasle is a licensed operator of remote gaming services under a License from the Country of Malta, but does not hold itself out as being familiar with the laws of any other jurisdiction as they apply to the services offered by our site.
